A Louisiana month-to-month rental agreement is used as a rental contract to rent residential property from a landlord that can be canceled at any time with a minimum 10 days’ notice. Although, it’s advised to have 30 days so each party has enough time to move out and find a new tenant.
After a rental application is collected the landlord should review the tenant’s credit before signing. If approved, the landlord should ask the tenant for the equivalent of one (1) month’s rent as the security deposit in case there is any damage on the premises after move-out. The landlord should always perform a credit check on every lessee before committing to this type of tenancy.
Minimum Termination Notice
To terminate a month-to-month lease, landlords and tenants must give at least ten (10) days’ notice from the next payment date (CC 2728). This is the same notice for rent increases by the landlord.
