A Nebraska residential lease agreement is for a fixed-term between a landlord and tenant for the renting of property for monthly payments. It is advised that the landlord get the tenant’s credit information (through a rental application) before authorizing an agreement to make sure that the person has a job and no outstanding debts that would prohibit the payment of rent. After a thorough analysis and approval the lease should be made ready to sign (recommended to initial every page) and keys should be granted after the security deposit and first month’s rent has been paid.

Security Deposit Laws

Maximum Amount ($) – The landlord cannot demand any more than one (1) month’s rent from the tenant except for if the tenant has a pet, in which case the landlord may demand as much as an additional 25%. (§ 76-1416)

Returning – The security deposit must be returned to the tenant within two (2) weeks of the termination of the lease. (§ 76-1416)

Required Disclosures

Lead-Based Paint Disclosure – Any building constructed prior to January 1st, 1978 may contain lead-based paint, this must be disclosed to the tenant should that be the case.

Identity Disclosure – The landlord is required to disclose the identity of anyone authorized to step foot on the property and anyone who is authorized to represent them. (§ 76-1417)

Rent Grace Period

There is no grace period in the state of Nebraska; rent is expected to be paid at the beginning of the rental period as described in the lease. While there are no statutes that dictate the amount of an applicable late fee, an amount can be determined and agreed upon in the lease (§§ 76-1414(1)).
