A Louisiana sublease agreement allows for a tenant who is under a lease with a landlord to lease a portion of or the entire space to someone else (sublessee). The term for the new tenant cannot be for any duration that lasts longer than the original lease agreement with the landlord. Subletting is often prohibited in a standard one (1) year lease contract. Therefore, it is required that the tenant receive written consent from the landlord. The original tenant (sublessor) should keep in mind that he or she will be exposed to property damage, unpaid paid, and any evictions that may need to be completed on behalf of the sublessee’s negligence.

Therefore, it is recommended to properly screen all sublessee’s through the use of a rental application before allowing access to the property and signing a binding contract.
