A Michigan one (1) year residential lease agreement allows landlords and tenants to engage in a legally binding contract for the use of the property. Then fill in the blanks form if completed usually after both lessor (landlord) and lessee (tenant) agree to the terms and conditions of a rental contract.

The most common terms that the lessor and lessee will go back and forth are:

  • Monthly rental amount
  • Security deposit
  • Utilities – Who will pay for electricity, water, cable, internet, etc.
  • Parking fees

The landlord may ask for the tenant to complete an application to make sure that he or she is able to reliably make monthly payments.

Security Deposit Laws

Maximum Amount ($) – Security deposits are permitted to be a maximum of one and a half (1.5) months’ rent that the tenant must pay upfront (§ 554.602).

Returning – The landlord must return the security deposit, minus any justified and itemized deductions, within thirty (30) days from the occupancy termination date (§ 554.609).

Required Disclosures

Domestic Violence Victims – The tenant must be given the following notice in the rental contract, visibly on the premises, or by personal delivery, “A tenant who has a reasonable apprehension of present danger to him or her or his or her child from domestic violence, sexual assault, or stalking may have special statutory rights to seek a release of a rental obligation under MCL 554.601b.” (§ 554.601b(1))

Inventory Checklist – At the commencement of the lease, the tenant must be given an inventory checklist that will include all items in the rental unit owned by the landlord and a description of the property’s current condition. This document must be returned to the landlord with any applicable amendments, within seven (7) days of the tenant moving in (§ 554.608).

Lead-Based Paint Disclosure – Lessors of rental units built prior to 1978 must give lessees a notice that informs them of the dangers of toxic paint that exists in most homes from this time period.

Notice Information – The lease agreement must include an address where the tenant can send legal notices, along with a statement that relays that the contract is required to comply with the Truth in Renting Act (§ 554.634).

Security Deposit Receipt – After receiving a security deposit, the landlord will need to give the tenant a receipt that states where the money was deposited (§ 554.603).

Rent Grace Period

The is no rent grace period in Michigan (no statutes). If the tenant is unable to pay rent or if they refuse to do so, the landlord may issue them with a 7-day notice to quit (Form DC 100a) (§ 554.134(2)).
