A Maine month to month rental agreement is used by a property owner (lessor) and tenant (lessee) seeking an ongoing landlord-tenant relationship. As long as either party does not decide to change or void the agreement, usually with at least thirty (30) days notice, the contract remains valid. To protect the lessor, it is advised that a security deposit of at least one (1) month be required in the chance the lessee decides to vacate the premises or if there is damage left on the property.

Once both parties have authorized the agreement it becomes valid and binding until the end of the term.

Disclosures

  • Radon Disclosure – It is required that if there have been high levels of Radon that the disclosure form be attached and signed.
  • Energy Efficiency Disclosure – Must be completed and signed by the tenant at the start of the lease.
  • Lead-Based Paint Disclosure – It is required that if the housing unit was built prior to 1978 that the lead-based paint disclosure form be attached and signed.

Minimum Termination Notice

A month-to-month lease agreement can be canceled at any time as long as the landlord or tenant sends the other party notice at least thirty (30) days before the next payment date (§ 6002).
