A South Carolina month-to-month lease agreement is between a landlord and tenant for the renting of a property that can be terminated with 30 days’ notice. There is no expiration date to the lease, and the contract renews every month upon payment by the tenant. Otherwise, a month-to-month lease agreement must follow all the landlord-tenant laws in the State (Title 27, Chapter 40 – Residential Landlord-Tenant Act).

It is recommended that, before the contract is signed, the landlord verify the tenant’s credentials with the rental application to avoid any type of eviction in the future.

Lead-Based Paint Disclosure – If the housing unit being rented was built before 1978, the landlord must have the tenant sign the lead disclosure to report the existence of any hazardous paint on the premises.

Minimum Termination Notice

Thirty (30) days. Either the landlord or tenant may terminate the monthly contract by providing the other with written notice at least thirty (30) days in advance (§ 27-40-770(b)).
