A Montana sublease agreement is a real estate contract used to allow a tenant to be able to rent their property to someone else in return for monthly payment. The landlord will usually need to grant permission or at the very least be notified of the sublet arrangement. The sublease cannot extend further than the original lease end date that is in place between the landlord and tenant.

The tenant should understand that any and all legal, monetary, and personal liability will come from any;

  • Damage
  • Non-Payment
  • Not Vacating the Premises at the appropriate time

The tenant will need to provide the sublessee the following disclosures to be signed and attached to the sublease agreement;

  • Lead Paint – If the residential unit was built prior to 1978. You can usually check this with the local assessor’s office.
  • Mold – This form is mandatory is must be signed by all parties and attached to the contract.
  • Move-in Checklist – To be completed and signed upon move in and move out by both the sublessor and sublessee.
