A New Mexico month-to-month lease agreement allows a landlord or tenant to enter into a binding contract where either party can terminate with 30 days’ notice. Like any lease agreement, the parties will agree to a monthly rent amount, utility and services, and any other agreed-upon terms. After negotiating, the landlord should refer to a rental application to make sure the tenant is able to pay rent. Once approved, the landlord and tenant should sign the agreement.
Lead-Based Paint Disclosure – If the landlord is aware of any lead paint existing on the premises, or if the structure was built prior to 1978, the above-linked disclosure form must be signed and attached to the agreement.
Minimum Termination Notice
A landlord or tenant is able to terminate the lease providing they supply the other party with at least thirty (30) days’ notice (NM Stat § 47-8-37).
