New Mexico Month to Month Rental Agreement – PDF
A monthly lease agreement is a tenancy whereas the landlord and tenant establish an arrangement the begins and ends every thirty (30) days. The period renews upon payment by the tenant to the landlord for another term and the tenancy at will has no end date and may only be revoked or altered via notice by either party. According to State law (§ 47-8-37), the notice must be at least one month in advance and is recommended that it be in a certified letter form to ensure legality.
Upon signing an agreement, the landlord is recommended to view the tenant’s income and employment history to make sure the tenant is credible. After review of the application and if approved a lease should be drafted and prepared for signature.
- If the landlord is aware of any lead paint existing on the premises or it was built prior to 1978, the disclosure form must be signed and attached to the contract.
