South Carolina Month to Month Rental Agreement – PDF Template
The South Carolina month to month lease is a rental arrangement sometimes referred to as a Tenancy At Will, that allows a person to occupy property and pay rent on a thirty (30) day basis. There is no expiration date to the lease and the contract renews every month upon payment by the lessee to lessor.
The contract, like a standard residential lease agreement, must adhere to the State laws regarding tenancy at will under § 27-40-770 which details that the landlord or tenant may cancel the agreement at anytime with 30 days.
It is recommended before the contract is signed that the landlord verify the tenant’s credentials with the Rental Application in an effort to avoid any type of eviction in the future.
Lead Based Paint – If the housing unit being rented was built before 1978, the landlord must have the tenant sign the lead disclosure to notify of any existence of the hazardous paint on the premises.
