The Florida month-to-month lease agreement is a rental contract between a landlord and tenant that continues every 30 days until it is cancelled by either party. In order to terminate, a minimum of fifteen (15) days is required by statute. This notice is usually sent via certified letter (with return receipt), hung on the door of the tenant, or hand-delivered.
Laws – § 83.03(3)
When accepting a tenant the landlord should do the following;
- Perform a credit and background check to make sure that the person is able to pay the suggested amount every month.
- Accept one-month’s security deposit in case of property damage and last month’s rent in case the tenant does not pay.
- If the residential unit was constructed prior to 1978, the lead based paint disclosure is required to be attached and signed.
