An Idaho month-to-month rental agreement allows a tenant to lease a residential unit on a recurring thirty-day (30) basis. The contract renews every month automatically as long as the property owner and lessee do not send notice to one another changing or terminating the agreement. It is recommended that the landlord seek one or both of the following from the tenant to protect themselves from a negative tenancy experience: a) run a credit check and verify income through the rental application and/or b) collect a security deposit (for damage) and last month’s rent (in case the lessee does not pay). Once the landlord and tenant agree to the terms and all deposits have been paid, the parties can sign the document and tenancy will commence as per the contract.
Minimum Termination Notice
Either party may terminate a month-to-month tenancy as long as one (1) month’s notice is provided by the terminating party (§ 55-208).
