A New Mexico sublease agreement is a real estate contract that establishes a relationship between a tenant under a lease and another individual (sublessee) who will be renting the same property. The current tenant (sublessor) has the option of renting the entire unit or just a portion of it. It is common for standard leases to prohibit the use of sublet arrangements, so the sublessor will probably have to seek written permission from the landlord or property manager for the sublease to take effect.
It should be noted that the sublessor is responsible for any wrongdoing or failure to pay rent. If the sublessee needs to be evicted, the sublessor will be legally liable for all costs related to the eviction. For these reasons, it is highly advised that the sublessor review the sublessee’s credit and employment through the rental application.
