Virginia month-to-month rental agreement is a residential contract that is structured so that the term updates on a monthly basis by payment of rent. Upon acceptance of the rental payment by the landlord, the agreement continues and renews for another thirty (30) days. In other words, there is no end date to the contract as long as the tenant pays rent, usually on the first (1st) but can be another day as decided by the parties.

  • As per federal law, all residential units built before 1978 shall require the tenant to authorize the lead-based paint disclosure form. After the tenant signs, the disclosure should be attached to all original leases.
  • Upon move-in, the landlord should provide the inspection checklist to ensure that the tenant will not be unjustly billed for property damage that is already in existence.

Minimum Termination Notice

Unless the rental agreement specifies another notice period, both the tenant and landlord may terminate a monthly lease by giving the other at least thirty (30) days’ notice before the start of the next rental period (§ 55-248.37(A)).
