A Florida residential lease agreement binds a landlord and tenant to rent a property on a fixed term, usually for a one (1) year period. Before writing an agreement, the landlord will usually run the tenant’s credit through a rental application and, if approved, begin the process. At the time of lease signing, the tenant is obligated to pay a security deposit, 1st month’s rent, and any additional fees attributed to the property (e.g. parking fee, pet fee, etc.).

Security Deposit Laws

Maximum Amount ($) – No limit on security deposit amount in State law (§ 83.49).

Returning – The landlord must return the security deposit to the tenant within fifteen (15) days after the tenant has vacated the premises. If deductions were made due to damages, the landlord must notify the tenant within thirty (30) days (§ 83.49(3a)).

Required Disclosures

Identification – The tenant must be provided with a written disclosure detailing the name and address of the landlord or the person authorized to receive notices on the landlord’s behalf (§ 83.50).

Radon – The following disclosure must be provided to any new tenant (§ 404.056(5)):

“RADON GAS: Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your county health department.”

Security Deposit – The landlord must provide a security deposit disclosure (per state law) to any new tenant in the lease agreement or within thirty (30) days after receipt of a security deposit (§ 83.49).

Lead-Based Paint Disclosure – Must be disclosed if the property was constructed prior to January 1, 1978.

Rent Grace Period

There is no grace period in the State of Florida. Rent is due at the “beginning of each rent payment period” (§ 83.46(1))
